Terms and Conditions

Where applicable all prices are subject to VAT at the current rate.

Prices are based on the current costs of production and, unless otherwise agreed in writing, are subject to amendment at any time where such amendment is required to meet any rise in costs incurred by Capitol Image. Quotations are valid for no more than 30 days.

All work is undertaken on the condition that a ready to print, high resolution file created in an approved professional graphics program is supplied and is accompanied by a colour proof and official purchase order with the exact specification.

Additional artwork required to correct any file will be charged at the current rate (£40.00 per hour).

It is not possible to guarantee that the digital inkjet printing process will render an exact match of the colours on proofs supplied by the customer, particularly in the case of Pantone colours. Where specifically requested to do so prior to commencement of any work, Capitol Image will endeavour to match colours as closely as possible to proofs supplied and reserves the right to charge for additional work required to amend files, print test files and supply proofs to the customer for approval.

It is the customer's responsibility to ensure the complete accuracy of electronic files supplied. No liability will be accepted by Capitol Image for any errors not corrected by the customer prior to printing, including but not limited to errors in text, layout, spelling and image quality. Capitol Image assert the right to refuse the printing of artwork which it considers to be in breach of copyright or is otherwise considered to be illegal, offensive or libellous.

The customer shall indemnify and hold Capitol Image harmless against all claims, demands, costs, expenses (including but not limited to legal costs and disbursements), losses and damages arising from or suffered or incurred by reason of the work it is required to produce pursuant to a customer order being or alleged to breach copyright or be illegal, offensive or libellous.

Should any work ordered be cancelled or suspended by the customer for a period of 14 days or more Capitol Image shall be entitled to payment for work carried out, material or products specially ordered and any other costs including storage.

Payment shall be made in full prior to despatch of goods unless credit terms have been agreed in writing by Capitol Image. Where credit terms have been agreed payment shall be made in full within 30 days of the end of the month in which the invoice was issued.

For invoices not settled within the agreed credit terms or for payments returned unpaid, Capitol Image reserves the right to charge interest at 5% above Lloyds TSB base rate at the time prevailing along with an administration fee to cover its debt recovery costs and any other costs relating to the collection of payment.

All goods remain the property of Capitol Image until paid for in full.

Capitol Image endeavour to deliver all goods within 5 working days from receipt of approved artwork but accepts no liability for any loss arising from delay or error in the delivery of goods. All deliveries will be charged at the rate prevailing at the date of such delivery.

A fast track service can be arranged for some products subject to consultation with Capitol Image that delivery times are achievable. An additional charge will be made for this service.

Goods must be examined thoroughly at the time of delivery. Capitol Image will not be held liable for loss or damage to goods where a signature of acceptance has been given to the courier. If goods are signed for unchecked and subsequently found to be damaged it is the customers responsibility to return them to us for consideration of replacement or repair. Any claims for damage, loss, non delivery or delay should be made within two working days.

Any claim with regard to the quality or quantity of the goods shall be made in writing within two working days or such goods shall be deemed to comply as to quality and quantity within the terms of the contract.

Capitol Image shall not be held liable for the actions or inactions of transport contractors in respect of delay, damage or non arrival of goods and no claim for consequential loss shall be accepted. The customer shall allow reasonable time for transport of goods to account for temporary delay and disruption of transport networks for whatever reason.

These conditions and all other express and implied terms of business shall be governed by and construed in accordance with English Law.
